Description

After prolonged course of brainstorming since February 1984 for rendering tangible assistance with the aid of alternate dispute resolution procedure to the aggrieved party / parties exposed to losses and injuries of diverse nature suffered during the course of execution of works / projects under works contract, I feel it apposite to suggest certain procedures to elude contractual disputes to the extent feasible and in the event such disputes are not resolved within a reasonable time compelling the party /
parties to invoke under painful necessity alternate dispute resolution procedure, to suggest course of action depending on the nature of disputes, by which the procedure can be accelerated / concluded in earliest time.
It is needles to mention that the course of action suggested to be followed by the respective parties for uninterrupted execution of any works contract and / or for minimising/ eliminating any dispute or difference during performance of contract, may be different for different contracts and for different factual matrix culminating to the disputes and differences between the parties.
